چکیده
هزینه جرم، نشان‌دهنده اهمیت نسبی مسئله وقوع آن است درصورتی‌که هزینه‌های ناشی از یک جرم، بالا (پایین) باشند، وقوع آن جرم یک مسئله بزرگ (کوچک) خواهد بود. استفاده از نظریه اقتصادی در قلمرو حقوق پدیده‌ای نوظهور و مناقشه برانگیز نیست، بلکه آنچه نوین و جدال‌برانگیز می‌نماید تعمیم تحلیل اقتصادی به گستره وسیعی از نهادهای نظام حقوقی با جوهره‌ای غیراقتصادی است. این پژوهش از نظر ماهیت توصیفی است و به توصیف و تعریف مباحثی همچون، سیاست جنایی و راهکارهای کاهش هزینه جرم پرداخته می‌شود. نتایج حاصل از پژوهش نشان داد که با وضع قوانین و مقررات سنجیده و آزموده می‌تواند سبب دشوار نمودن سوءاستفاده از فرایند کیفری و جلوگیری از اتلاف منافع اقتصادی و متعاقب آن کاهش هزینه‌های جرم، شد؛ و در یک سیاست جنایی کارآمد و مثمرثمر ابزارهای مدیریتی برای به حداقل رساندن هزینه‌های جرم می‌تواند متوجه ساختار مراجع رسیدگی و به‌کارگیری نیروی کار، بدون دستمزد یا با حداقل دستمزد باشد که می‌تواند در قالب به‌کارگیری تجربیات و نظریات اقتصاددانان و جرم شناسان، با رویکردی علمی به ابزارهای تفرید قضایی حاصل آید و یا در قالب به‌کارگیری روش‌های پیشگیری از جرم اقدام شود؛ سیاست جنایی انگلستان در مقایسه با ایران، با کاربست نهادها و از طٌرق مختلف در راستای پیشگیری از ارتکاب یا تکرار جرم در جهت جلوگیری از تراکم پرونده‌های کیفری و تراکم جمعیت کیفری با استفاده از تأمین حداقل هزینه‌های عدالت کیفری توانسته به نتایج مثمرثمر و قابل قبولی دست یابد و هزینه‌های مزبور را کاهش دهد که همین امر سبب رشد و تعالی دستگاه عدالت کیفری می‌شود.
